Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights include:– Spend for all salaries made (INFO # 3) at the rate accepted by the employer and worker.

– Pay of at least base pay (INFO # 1), the applicable Colorado or local base pay, and all earned overtime incomes without impermissible deductions from their earnings;.

– Pay of all made earnings without impermissible reductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS implements a number of Colorado’s wage and hour and other kinds of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For Equal Work Act. Please visit the Division’s Labor Statutes and Labor Rules webpages for present and previous versions of crucial Colorado labor statutes and guidelines.

Published Guidance: The Division’s primary kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notices, viewpoints, and explanations on various labor law topics; and.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you incomes, job you can send your employer a composed need for payment of salaries by mail, e-mail, text message, or other electronic ways. A written need might be sent out to the employer at the exact same time a Labor Standards Complaint Form for unsettled salaries is submitted with the Division. Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is gotten and examined, a letter describing the nature of the grievance and the amounts declared to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division might perform employer-wide direct examinations of possible infractions of Colorado wage and hour law. If you would like to submit an individual claim for overdue salaries, you need to submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct examination citation or one or more Notices of Assessment, an alleged employer may submit a Direct Investigation Appeal Form.
